What is an Alcoholic Beverage?
Any drink that has at least 1/2 of 1 percent alcohol is an alcoholic beverage. Ethyl alcohol, the active ingredient in alcoholic drinks, acts as a depressant. There are four types of alcoholic beverages: beer, wine, fortified wine, and liquor, each containing different amounts of alcohol.

You must be 21 years of age to purchase, possess, or drink alcohol. If you try and buy an alcoholic beverage in a store or a bar, you will be asked to prove your age. If you can't prove that you are 21 or older, the dealer cannot sell you an alcohol beverage (s562.11).

If you are under age 21, it is illegal for you to attempt to purchase any alcoholic beverage. For the first violation, you could be fined up to $500.00 and confined for up to 60 days or 6 months probation (s772.082).

Anyone who sells or gives alcoholic beverages to someone under 21, or who lets the person drink alcoholic beverages in a bar or store, is breaking the law (s562.11).

Can I borrow a Driver's License or I.D. Card or change the age on mine to show I'm 21 or older?
No. In both cases, you would be breaking the law.

 
Other Laws on Alcoholic Beverages
In Florida, there is zero tolerance for alcoholic beverages and anyone under age 21. If you are under the age of 21, you cannot:
  • Have an open container of alcoholic beverage in a car, whether you are drinking or not, or drink while driving, or drive a car under the influence of alcoholic beverages (s316.193-6, 316.193).
  • Be drunk or under the influence of drugs in public or on a public highway (s562-453;856.011).
  • Possess, drink, sell, or give liquor to any person in or on any public school or school grounds. You can be suspended or expelled for this (s562.11).
  • Be permitted to remain in a liquor store without lawful business (s562.48).
  • Carry liquor in a car; possess liquor on a public street, highway, or public place, even if the container is sealed (s562.111)
  • Be hired in an establishment where the main business is selling alcoholic beverages to be used on the premises (s562.111,562.13).

If you are found to be under the influence of alcohol or drugs, you may be issued a Driving Under the Influence (DUI) citation, which can cost up to $6,000.00 per incident, and your driver's license may be suspended. For adults, the legal limit of blood alcohol is .08 percent.

 
How is drinking Alcohol dangerous?
Drinking alcohol is dangerous because it can:
  • Damage your liver, mouth, esophagus, stomach, pancreas, brain, and heart.
  • Cause Fetal Alcohol Syndrome in an unborn child, which can create mental retardation.
  • Impair the brain, cause memory loss, and lower the ability of the brain to control behavior.
  • Impair your ability to perform motor skills such as driving a car.
     
Drugs and Narcotics
 
What are some of the dangerous drugs?
  • Methamphetamines (Crystal Meth)
  • Cocaine (Crack or Rock)
  • Hallucinogens: LSD, peyote, PCP, marijuana, Ecstasy
  • Narcotics: Heroin, opium, morphine, methadone
  • Stimulants (uppers)
  • Sedatives (downers)
  • GHB (Ecstacy), Ruphies, Homeboy

These are illegal drugs, except by prescription.

Marijuana is composed of THC (a mind altering ingredient), benzopyrene (causes cancer and is 70% higher in marijuana than cigarettes), carbon monoxide (highly poisonous), hydrocyanic acid (poison gas), acetaldehyde (solvent), tar (contains 50% more tar than a strong band of tobacco cigarettes; causes lung cancer).

 
What are some of the laws on narcotics and dangerous drugs?
It is illegal to:
  • Sell counterfeit controlled substances (s817.563, 831.31).
  • Sell, furnish, or give away any controlled substance, or sell, furnish, or give away any other liquid substance or material that you represent to be a controlled substance.
  • Possess, use, sell, transport, give away, offer, arrange, or negotiate to sell any controlled substance, or be under the influence of any controlled substance (s893.13-1-c, 893.13) or marijuana (s893-13) or narcotics or dangerous drugs (s859.05, 893.13).
  • Possess or be under the influence of nitrous oxide (s877.111).
  • Drive on any highway or road while under the influence of drugs (s316.193).
  • Possess any instrument or means used to inject an illegal drug (s893.147).
  • Make or use a false or changed prescription (s831.30).
  • Plant, cultivate, harvest, dry, or process marijuana or other drugs (s893.13-1-a).
  • Sniff glue or cement with toluene (s877.111).
  • Encourage, try to sell, or force any minor to break any of the narcotics laws (s859.05, 893.13, 135).
  • Use or be under the influence of dangerous drugs, unless they are prescribed by a licensed person, usually a physician (s859.05, 893.13).
Tobacco
 
What are the Laws about tobacco?
If you are under the age of 18, it is against the law to:
  • Purchase or attempt to purchase tobacco from a person or a vending machine (s569.11-12).
  • Smoke, sell, or give away any tobacco product to minors under the age of 18.
